Definitions and Interpretation
In this Refund Policy, the following terms shall have the meanings set forth below:
"Agreement" means the contract for services entered into between Client and Provider;
"Client" means the individual or entity purchasing services from Provider;
"Custom Development Services" means bespoke software development, website creation, application development, and related technical services;
"Digital Content" means data, guides, courses, templates, or other materials produced and supplied in digital form;
"Educational Materials" means courses, tutorials, documentation, guides, and instructional content;
"Provider" means Audacity DOO (Belgrade, Serbia) operating as Tech Powered Growth;
"Services" means all consulting, development, educational, and related services provided by Provider;
"Transaction" means any purchase, acquisition, or engagement for Services, whether paid or complimentary.
Application and Scope
This Refund Policy applies to all Transactions conducted through Tech Powered Growth services and forms an integral part of our Terms of Service. By engaging our Services, Client agrees to be bound by the terms and conditions herein. This policy governs refund eligibility, procedures, and limitations for all service categories offered by Provider.
Custom Development Services Refund Terms
Delivery Timeline Guarantee
Provider guarantees delivery of Custom Development Services within the timeline specified in the executed Agreement. In the event Provider fails to deliver the agreed-upon deliverables by the contractual deadline, Client shall be entitled to a full refund of all amounts paid, subject to the conditions and exclusions set forth herein.
Timeline Modifications
Should Client request modifications to project scope, requirements, or specifications that necessitate timeline extension, the parties shall execute a written amendment to the original Agreement establishing revised delivery dates. The refund guarantee shall apply to such amended timeline.
Exclusions from Refund Eligibility
Refunds shall not be available under the following circumstances:
- a) Services have been completed and delivered in accordance with Agreement specifications;
- b) Client has formally accepted deliverables through written confirmation;
- c) Delays are attributable to Client's failure to provide required materials, feedback, or approvals within agreed timeframes;
- d) Timeline extensions result from Client-requested scope changes or requirement modifications;
- e) Force Majeure events prevent timely delivery.
Digital Content and Educational Materials
Satisfaction Period
Client may request a refund for Digital Content and Educational Materials within fourteen (14) calendar days of purchase date, provided the request meets the criteria established in this section.
Refund Eligibility Criteria
Refunds for Digital Content shall be granted under the following conditions:
a) Content materially fails to match descriptions provided at time of purchase;
b) Technical defects prevent access to purchased materials, and Provider cannot resolve such issues within 72 hours of notification;
c) Content is demonstrably incomplete or substantially different from advertised specifications.
Digital Content Limitations
Important Notice:
Due to the instantaneous nature of digital delivery, refunds are not available for subjective dissatisfaction, change of mind, or purchaser's remorse after materials have been accessed or downloaded. By completing the purchase, Client acknowledges receipt of delivered content and waives rights to refund except as explicitly provided herein.
Consulting and Professional Services
Consulting services, strategy sessions, and professional advisory services are provided on a time-and-materials basis. Once services have been rendered, no refunds shall be available except in cases where Provider fails to perform scheduled sessions or materially breaches service obligations.
Cancellation Policy
Client may cancel scheduled consulting sessions with at least 48 hours advance written notice. Sessions cancelled with less than 48 hours notice are non-refundable. Provider reserves the right to reschedule sessions due to circumstances beyond reasonable control.
Refund Request Procedures
Request Submission
All refund requests must be submitted in writing to luka.zivkovic@techpoweredgrowth.comwith "REFUND REQUEST" in the subject line. Requests must include:
- a) Order number or transaction identifier;
- b) Date of original purchase or service engagement;
- c) Detailed explanation of grounds for refund request;
- d) Supporting documentation where applicable.
Processing Timeline
Provider shall review refund requests within five (5) business days of receipt. Approved refunds will be processed within seven (7) business days via the original payment method. All refund determinations are made at Provider's sole discretion based on the terms herein.
Alternative Remedies
Prior to processing refund requests, Provider may, at its discretion, offer alternative remedies including but not limited to: service credits, additional support, project modifications, or supplementary materials. Client's acceptance of such alternative remedies shall constitute full satisfaction of any refund claim.
Limitation of Liability
Provider's maximum liability for any refund claim shall not exceed the total amount paid by Client for the specific service or product in question. In no event shall Provider be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to refund requests or service performance.
Force Majeure
Provider shall not be liable for delays or non-performance resulting from acts of God, natural disasters, government actions, civil unrest, labor disputes, internet service interruptions, or other circumstances beyond Provider's reasonable control. In such cases, Provider shall work with Client to reschedule services or, if mutually agreed, process appropriate refunds.
Governing Law and Jurisdiction
This Refund Policy shall be governed by and construed in accordance with the laws of Serbia. Any disputes arising from or relating to refund claims shall be subject to the exclusive jurisdiction of Serbian courts. This policy is incorporated by reference into Provider's Terms of Service.
Policy Modifications
Provider reserves the right to modify this Refund Policy at any time upon thirty (30) days written notice to existing Clients. Modifications shall not affect pending refund requests or existing service agreements. Continued use of Services after policy modifications constitutes acceptance of revised terms.
